Mataiciwa claims that Malimali engaged in harassment and intimidation tactics towards herself and the staff of the Fijian Elections Office, who are serving as witnesses in an ongoing case related to allegations of misconduct involving Malimali during her previous tenure. Furthermore, she asserts that Malimali misused her position to extract sensitive information from her office, utilizing that information to further intimidate and undermine the Fijian Elections Office and Mataiciwa herself.
The complaint references a raid by FICAC on the Electoral Commission office back in September, which led to the Electoral Commission seeking legal assistance from the Fijian Elections Office’s legal team. Mataiciwa expressed concern, alleging that Malimali’s actions constitute a deliberate campaign to discredit the Elections Office and impede the judicial process.
Mataiciwa characterized the situation as a “witch-hunt,” aimed at obstructing justice through harassment. She emphasized that the Fijian Elections Office is in the position of having to respond to what she describes as unfounded allegations directed at them to the Constitutional Offices Commission and the Chief Registrar’s Office.
Highlighting the gravity of the situation, Mataiciwa remarked that these actions violate constitutional protections afforded to witnesses and amount to clear abuse of power and obstruction of justice, as defined under sections 190(d) and (e) of the Crimes Act 2009. She has urged the Fiji Police Force to conduct a thorough investigation into Malimali’s conduct and to consider criminal charges against her.
