The Electoral Commission (EC) has provided clarity regarding the participation of Members of Parliament (MPs), including Independent MPs, in establishing new political parties. In a meeting held on December 11, 2025, EC Chairperson Justice Usaia Ratuvili confirmed that there are no legal barriers preventing MPs from joining or forming new political parties under current electoral laws.

The EC reviewed the relevant legislation, specifically the Electoral (Registration of Voters) Act 2012, the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013, and the Electoral Act 2014. They found no explicit provisions that restrict MPs from changing their party affiliation or from engaging in the formation of new political entities.

Notably, Section 20(2) of the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013 allows MPs elected under a deregistered political party to serve their parliamentary term as independent MPs or to join other parties. This means that MPs from such deregistered parties can continue their legislative duties while exploring new political affiliations.

Additionally, the EC emphasized that MPs are permitted to participate in establishing a new party, as long as they are affiliated with only one political party at a time, in adherence to the law.

Justice Ratuvili stated that the clarification serves the public interest and reaffirms the EC’s dedication to upholding the Constitution and electoral regulations in Fiji. This decision aims to provide much-needed guidance concerning the evolving political landscape, particularly amid discussions on party deregistration and the role of independent MPs.

These developments signal a significant moment in Fijian politics, fostering opportunities for renewed political engagement and the potential creation of new parties in a dynamic parliamentary environment.
