Driver bailed in tragic accident case after death of five-year-old along Lekutu-Nabouwalu Highway

The driver accused of causing the death of a five-year-old boy on the Lekutu-Nabouwalu Highway in Bua was released on strict bail terms at the Labasa Magistrate’s Court yesterday.

Ashneel Sahil Deo appeared before Magistrate Bimsara Jagodage. It is alleged that Deo did not stop after the accident incident. He faces charges of dangerous driving occasioning death and failure to comply with requirements following an accident.

On June 15, 2024, the minor, who was standing with his father and attempting to cross the road, reportedly ran across suddenly. The child passed away the following day at Labasa Hospital. Deo was apprehended five days later on June 19 after initially evading police.

During the police caution interview, it is reported that the accused opted to remain silent. Police prosecutor Sergeant Vignesh Prasad did not oppose bail but requested two sureties from the defense.

Defense lawyer John Prasad initially argued for one surety but eventually agreed to two. A $1000 cash bail bond was also imposed.

Magistrate Jagodage set several conditions for bail: the accused must not reoffend, must reside in Naduna, Labasa with his father, and must not change his address. Deo is required to appear at all court mentions until the case is resolved and must not interfere with state witnesses. He is also prohibited from applying for any travel documents while the case is ongoing.

The case was adjourned to August 29, 2024, for plea at the Nabouwalu Magistrate’s Court. Deo’s lawyer sought permission to transfer the case to the Labasa Magistrate’s Court, to which Magistrate Jagodage advised to formally apply for the transfer.
