Christopher Pryde, the suspended Director of Public Prosecutions, has notified Justice Anare Tuilevuka, the Chairman of the Constitutional Tribunal, of his inability to attend the tribunal’s hearing scheduled for next week. In his correspondence, Pryde expressed concerns regarding the fairness of the tribunal proceedings, stating that he cannot adequately defend himself under the current circumstances.
Pryde argued that continuing the hearing while he is deprived of his salary and entitlements not only undermines the President’s directive for the tribunal to ensure a fair process but also violates international conventions established by the International Labour Organisation, to which Fiji is a signatory.
He attributed the situation to the actions of the acting Chief Justice and the Judicial Services Commission (JSC), which recommended the suspension of his salary and benefits prior to the hearing. According to Pryde, this is an infringement on the tribunal’s proceedings and worthy of contempt.
Furthermore, he noted that the Prime Minister’s public backing for the reinstatement of his salary supports his position. Emphasizing a commitment to his role, Pryde stated he would not be pressured into resigning or participating in hearings that prevent him from presenting a robust defense.
Pryde reiterated his right to a fair process and urged the tribunal to refer the matter back to the President, seeking a delay until his salary situation is addressed. He indicated that he is prepared to continue with legal representation once his entitlements are reinstated.
