DPP Pryde Cleared: Tribunal Findings Rewrite Misbehaviour Rules

A three-member Tribunal has determined that the allegations of misbehaviour against Christopher Pryde, the Director of Public Prosecutions (DPP), were not substantiated. The Tribunal, chaired by Justice Anare Tuilevuka with Justices Chaitanya Lakshman and Samuela Qica as members, delivered their unanimous findings to His Excellency, President Ratu Naiqama Lalabalavu, on December 23, 2024.

Following a thorough review of the Tribunal’s report, the President expressed commendation for the Tribunal’s work, noting its significance in defining “misbehaviour,” a term not previously outlined in the nation’s Constitution. This new interpretative framework aims to aid the Judicial Services Commission (JSC) in addressing complaints against judicial and quasi-judicial officials, including the DPP.

The Tribunal has also emphasized the necessity for clear policies to guide the handling of complaints involving judicial officers. In absence of existing regulations, these policies would ensure consistent and transparent decision-making processes for the JSC.

Going forward, Pryde’s suspension, which had been in effect since April 13, 2023, will be lifted. He will resume his duties with immediate effect, following the terms of his existing service agreement with the government, including the prompt repayment of his unpaid salary and benefits.

The Tribunal’s report is now publicly accessible as stipulated in the Constitution, allowing for greater transparency and accountability within the judicial system.

In summary, this outcome not only reinstates Pryde but also lays a foundational legal precedent for future cases involving judicial conduct, fostering hope for enhanced governance within Fiji’s legal framework. By establishing clear policies and definitions, the Tribunal’s work contributes to strengthening the integrity and accountability of judicial processes.
