A tribunal established under Fiji’s Constitution has exonerated the Director of Public Prosecutions (DPP), Mr. Christopher Pryde, from allegations of misconduct, determining there are no valid grounds for his removal from office.

The tribunal, led by Justice Anare Tuilevuka and including Justice Chaitanya Lakshman and Justice Samuela Qica, submitted its findings to President Ratu Naiqama Lalabalavu on December 23, 2024. After thorough review and necessary consultations, the President endorsed the unanimous decision of the tribunal.

Key findings of the tribunal highlighted that there was a complete absence of evidence supporting the allegations against Mr. Pryde. Additionally, the tribunal’s report plays a significant role in defining the ambiguous term “misbehaviour,” which lacks a clear definition in Fiji’s Constitution. The tribunal also recommended that the Judicial Services Commission (JSC) develop comprehensive policies and frameworks for managing complaints against judicial officers, aimed at ensuring greater consistency, transparency, and accountability.

To facilitate Mr. Pryde’s return to his role, several steps are outlined: his original Agreement of Service from 2019 will be reinstated, any owed salary and benefits will be promptly reimbursed, and he will coordinate with the Chairperson of the Judicial Services Commission for a smooth transition back to his office, including returning official property and equipment.

The President praised the tribunal members for their professionalism and significant contributions to Fiji’s legal framework. The tribunal’s full report is now publicly accessible, providing transparency about the proceedings.

This resolution not only restores Mr. Pryde to his role but also reinforces the integrity of Fiji’s legal system, showcasing a commitment to due process and the rule of law. The recommendations for enhancing procedural standards are a proactive step towards building a more robust framework for handling future complaints.

In summary, this tribunal’s decision reflects a strong commitment to legal integrity and accountability, which bodes well for Fiji’s future governance and judicial processes.
