A 49-year-old man, who pleaded guilty to raping his 13-year-old niece, showed visible remorse during a recent court appearance in the High Court in Suva as he awaited sentencing. He faces multiple charges, including four counts of sexual assault, one count of rape, and one count of indecent assault, all related to incidents that occurred last September when the young victim visited his home.

Justice Pita Bulamainaivalu presided over the case and emphasized the need for coherent character references, noting that the letters submitted by the village headman and a church pastor lacked clarity. Although these letters recognized the man’s contributions to the community prior to the offenses, the judge called for more articulate testimonials. The defendant’s attorney, Atama Waqanivavalagi, proclaimed the man’s acknowledgment of his wrongdoing and expressed his remorse. However, he also highlighted the challenges faced in reaching out to the victim’s family due to the man’s five-month remand in custody.

The assault came to light when the victim’s mother reported it to the Vunidawa Police Station, which initiated the legal proceedings. The State has recommended a 10-year prison sentence for the man, who will remain in custody until sentencing set for March 18.

This case reflects the critical issue of sexual violence, particularly within families, and underscores the importance of victims feeling empowered to report such crimes. The courage displayed by the victim in coming forward and the judicial system’s swift response highlight society’s commitment to safeguarding vulnerable individuals and ensuring justice is served.
