Court Upholds Stop Departure Order for Former Accountant President

The Nadi Magistrate’s Court has rejected former Fiji Institute of Accountants president Zarin Khan’s request to have a stop departure order lifted. This order, imposed by FICAC Commissioner Barbara Malimali, was put in place last year as part of an ongoing investigation by the Fiji Independent Commission Against Corruption (FICAC).

Khan had approached the court seeking permission to travel abroad for medical treatment. However, Magistrate Semi Babitu ruled that the issuance of the stop departure order was valid and within the rights of the FICAC Commissioner. He noted that the court lacked jurisdiction to entertain the matter, referring to the powers vested in Malimali by the Fiji Independent Commission Against Corruption Act of 2007.

Following the ruling, Khan has been granted a 28-day period to appeal the decision if he chooses to do so.

This situation underscores the importance of regulatory frameworks designed to combat corruption and ensure accountability, highlighting the commitment of institutions like FICAC to uphold these principles in Fiji.

While the outcome may be disappointing for Mr. Khan, it demonstrates the legal processes in place meant to protect the integrity of investigations and ensure that justice is served in a fair manner.
