Court Orders Squatters to Vacate Controversial Land in Fiji

The High Court in Suva has ruled that squatters occupying land in Tacirua East, owned by Ridgeview Estate Pte Ltd, must vacate the premises. The decision was made following an affidavit submitted by the company’s director, Anthony Eugene Ah Koy, which asserted that the individuals residing on Khalsa Rd have no legal claim to the land.

Ridgeview Estate expressed challenges in assisting the squatters, citing a lack of identifiable information about them. Despite acknowledging the company’s ownership since 2017, some squatters claimed their occupation predated the leases granted by the landowning mataqali and stated they were unaware of the land transfer to Ridgeview Estate.

Justice Savenaca Banuve ruled in favor of Ridgeview Estate, ordering the removal of the squatters. He mandated the Sheriff of the Court, with police assistance, to ensure a safe and orderly disconnection and removal of any illegally installed utilities, including electricity and water connections.

This ruling underscores the complexities surrounding land ownership and squatter rights in Fiji, a nation where informal settlements are prevalent. It brings to light the necessity for more comprehensive solutions that could address housing shortages and assist those affected by such legal actions.
