The High Court in Lautoka has authorized the destruction of a significant batch of illicit drugs, specifically methamphetamine, with a total street value estimated at $2 billion. This decision was made by Justice Aruna Aluthge after the Office of the Director of Public Prosecutions (ODPP) submitted a request under Section 30 (3) of the Illicit Drugs Control Act 2004.
The case relates to Justin Ho and nine other individuals accused of importing over 4.2 tons of methamphetamine into Fiji last December. The ruling confirmed several critical protocols to ensure the destruction process is carried out safely and transparently.
Key provisions of the ruling include:
1. A police officer of at least Assistant Superintendent rank will oversee the destruction of the drugs, utilizing incineration or other secure methods.
2. Prior notification of two weeks must be provided to the court and involved parties before the destruction occurs, detailing the date, location, and method.
3. Legal representatives of the respondents may observe the destruction process, subject to security protocols.
4. The destruction process must be documented through photographs and preferably video recordings for transparency.
5. The ODPP can invite the Resident Magistrate to witness the destruction for further oversight.
6. A detailed report will be prepared by the overseeing officer and two witnesses, certifying that the drugs were disposed of per the court’s order.
7. This report must be filed in court no later than two weeks following the destruction.
This ruling not only reinforces the judicial system’s commitment to combating drug trafficking but also highlights the importance of transparency in legal processes. By allowing for oversight and documentation, the court aims to ensure that such procedures are credible and accountable.
Overall, this decision marks a significant step forward in the legal efforts to eradicate drug-related crime in Fiji, demonstrating a strong stance against the trafficking of dangerous substances while ensuring that all proceedings are conducted with integrity.
