In a significant ruling, the Magistrate’s Court in Labasa has directed the Land Transport Authority (LTA) to refund a businessman $20,000 following the revocation of multiple Traffic Infringement Notices (TIN) issued against him. The case, involving Sanjeev Reddy, took place on Friday, where he appeared before Magistrate Safaira Ratu, represented by attorney John Prasad.
Mr. Reddy, who owns a trucking business, faced a series of fines. Initially, on July 17, 2019, he received a $2,000 fine for allowing another person to operate his vehicle with an excessive load. This was followed by two additional TINs totaling $18,000, which ultimately forced him to shut down his trucking business and switch to operating a small shop for his livelihood.
During the hearings, Magistrate Ratu evaluated the testimonies from both Mr. Reddy and various witnesses. She concluded that the prosecution failed to establish a strong enough case to justify the fines, calling into question the credibility of the prosecution’s experts. Consequently, she dismissed the violations, acquitted Mr. Reddy, and mandated the LTA to refund all fines paid within a 21-day period.
This ruling offers a glimmer of hope for individuals who might find themselves burdened by heavy penalizations due to unclear or disputed evidence.
