The legal representation for Daniel Whippy, managing director of Carpenters Fiji Limited, has dismissed claims from the Fiji Independent Commission Against Corruption (FICAC) as “hogwash.” This statement was made in response to FICAC lawyer Sera Fatafehi’s assertion in court that stem cell procedures can indeed be performed in Fiji.

Whippy, who is facing charges related to abuse of office, sought a modification to his bail conditions to allow for travel to the United States for a specialized stem cell treatment for his knee. During a court session yesterday, FICAC presented two affidavits to contest Whippy’s bail modification application. Fatafehi referenced support from a FICAC Investigation Officer and Dr. Alvin De Asa, an orthopedic specialist from Nasese Private Hospital, to argue against Whippy’s request.

Whippy’s lawyer, Suruj Sharma, countered this argument, emphasizing that the affidavits did not address the specific stem cell procedure in question. He argued that this invasive treatment is only available in the U.S., a claim that he stated Ms. Fatafehi had not adequately challenged.

Fatafehi acknowledged the challenge in confirming local availability of qualified surgeons for this specific procedure, but mentioned that a surgeon is expected to return to Suva soon and is willing to provide a statement. Magistrate Sufia Hamza expressed concern that FICAC had sufficient time to prepare and file necessary affidavits, especially given the urgency surrounding Whippy’s medical condition.

Sharma continued to advocate for his client, highlighting that Whippy is experiencing significant pain that affects his daily activities. The court has given FICAC until Thursday to present their affidavits, with a subsequent hearing scheduled for November 6. Whippy was excused from this week’s court proceedings.

This case illustrates the complexities of legal and medical issues intertwined within the judicial process.
