The High Court in Suva is convening today to review the status of Tevita Qaqa Kapawale’s application for additional disclosures from the State. Kapawale faces serious charges, including five counts of murder, one count of attempted murder, and one count of criminal intimidation. His legal representative, Tobia Ravuniwa, presented his case before Justice Daine Tuiqereqere.

The allegations against Kapawale stem from an incident on May 18, 2021, when he purportedly killed five individuals aboard the FVO Tiro II in Fiji’s waters. Additionally, he is accused of attempted murder in the case of Kaminieli Tucama and intimidation of Mitieli Cama, who is 49 years old.

During the court proceedings, Mr. Ravuniwa stated that since they have only recently taken over Kapawale’s defense, they are uncertain about the status of the necessary disclosures at the Remand Centre; they may have been misplaced. He suggested that they could photocopy existing documents to alleviate any difficulties for the State.

Justice Tuiqereqere reminded Mr. Ravuniwa that the court would not revisit the ruling related to the caution interview, as it had already been adjudicated. In contrast, State prosecutor Triveshni Sharma noted that challenging the caution interview would entail recalling all witnesses, which would be logistically difficult. She added that Kapawale had previously chosen not to seek assistance from Legal Aid.

Justice Tuiqereqere expressed a desire to resolve all pretrial matters before taking his legal vacation.
