Court Drama: High Stakes Murder Case Returns to High Court in Suva

The High Court in Suva is set to resume its proceedings today regarding Tevita Qaqa Kapawale’s petition for additional disclosures from the State. Kapawale faces severe charges including five counts of murder, one count of attempted murder, and one count of criminal intimidation. In the court session, which was presided over by Justice Daine Tuiqereqere, Kapawale was represented by his attorney, Tobia Ravuniwa.

The allegations against Kapawale stem from a tragic incident on May 18, 2021, in which five men were reportedly killed aboard the FVO Tiro II in Fiji’s waters. In addition, he allegedly attempted to take the life of Kaminieli Tucama and was accused of intimidating Mitieli Cama, aged 49.

Lawyer Ravuniwa expressed concerns regarding their client’s access to necessary legal documents, questioning whether Kapawale’s disclosures remained intact at the Remand Centre or if they had been misplaced. He noted that they were prepared to photocopy the documents if it would ease the process for the State.

In previous discussions, Ravuniwa sought to contest the caution interview; however, Justice Tuiqereqere clarified that the court would not revisit the voire dire ruling as it had already been established. State prosecutor Triveshni Sharma responded by stating that challenging the caution interview would necessitate recalling all witnesses, a task that would be logistically challenging. She pointed out that Kapawale had the opportunity to seek assistance from Legal Aid but chose not to do so.

Justice Tuiqereqere urged both parties to resolve all pretrial matters before he embarks on his legal vacation.
