The Magistrates Court in Suva has denied former Attorney-General Aiyaz Sayed-Khaiyum’s request for a bail variation that would allow him to travel abroad for medical reasons. Resident Magistrate Sufia Hamza stated that Sayed-Khaiyum had already received medical treatment for heart and kidney issues in Singapore, and local urologist Dr. Sireli Kaloucava confirmed that he could receive post-treatment care in Fiji.
In her ruling, Magistrate Hamza referenced relevant case law, noting that the onus is on the applicant to demonstrate “special and imperative circumstances” that would justify a change in bail conditions. She also highlighted that both the purpose of the overseas visit and the potential disruption to the justice system are important factors in such applications.
Sayed-Khaiyum faces multiple serious charges, including six counts of abuse of office and seven counts of obstructing the course of justice, which fall under various sections of the Crimes Act. He was not present in court for this ruling. The court has scheduled the next mention of the case for September 3.
