The High Court has declined to grant an injunction that would have prevented Eliane Chandra, a former Fiji First candidate, from making negative statements about Arnold Chanel, the editor of Duavata News. Chanel sought the injunction in response to a Facebook post by Chandra dated April 25, 2025, in which she characterized him using derogatory terms such as “unqualified” and accused him of engaging in dishonest practices.

Chanel’s legal request aimed to restrain Chandra from distributing or disseminating any statements or materials he deemed defamatory across various platforms, including social media sites like Facebook and TikTok. He also requested that she remove any already published defamatory content pertaining to him.

In a ruling released on June 20, Justice Senileba Waqainabete-Levaci emphasized the need to balance freedom of speech against the potential harm to an individual’s reputation. The court acknowledged the significant reach of Chandra’s comments on social media but determined that her remarks did not specifically target Chanel’s work or qualifications.

The case draws parallels to recent discussions in Fiji surrounding the balance of free speech and the limitations imposed by defamation laws. For instance, similar cases have addressed the ramifications of public commentary and its influence on the judiciary, highlighting the challenges individuals face when exercising their rights to free expression.

The ruling represents a reaffirmation of the importance of free speech while also underscoring the necessity for individuals to be cognizant of the impact of their statements, particularly in the digital realm. Presenting a positive outlook, this case may inspire greater dialogue on responsible online conduct and the implications of freedom of speech. It also underscores the need for ongoing education regarding legal protections around public commentary to foster a more respectful discourse in society.
