Lawyers representing the Fiji Independent Commission Against Corruption (FICAC) and Sarika Devi Raj, a former finance officer of the Republic of Fiji Military Forces (RFMF), have received an extension to address additional disclosure issues related to Raj’s ongoing legal case. Raj appeared in Suva Magistrate’s Court, seeking a variation in her bail conditions which includes removing her requirement to report to the FICAC office regularly.
Raj is accused of engaging in acts that allegedly led to an improper gain of $182,404.99 between September 20, 2019, and June 19, 2020, specifically failing to disclose her ownership of Maleka Investment, a vendor for the RFMF, which has raised concerns about its implications for the RFMF’s rights.
During the court proceedings, Raj’s attorney, Mohammed Saneem, accused FICAC of misleading the court regarding the execution of a search warrant, and argued that they had not adequately provided the documentation necessary as directed by the RFMF’s legal director. He raised the critical question of jurisdiction, asking which authority should take precedence: the RFMF or the court.
Responding to the allegations, FICAC lawyer Lavinia Ravuikadavu denied misleading the court. She explained that while they executed the search warrant, they could only provide certain documents as Raj’s attorney needed to specify what information was required. Ravuikadavu mentioned that they had sent a communication on December 17, 2024, outlining their position regarding the documents.
Magistrate Pulekeria Low underscored the importance of FICAC providing the necessary documentation, given their role as the charging party in the case. Mr. Saneem was granted 14 days to submit a further request for documents, after which FICAC would have another 14 days to respond. Both parties are scheduled to return to court on January 23.
