Contract Controversy: Tribunal Clears Pryde of Misconduct Claims

The Tribunal investigating Christopher Pryde, the suspended Director of Public Prosecutions, concluded that a payment of USD 1,000 designated as superannuation into an overseas bank account was indeed outlined in his contract, which was approved and signed by the President.

The investigation revolved around allegations that there was no formal approval from the Judicial Services Commission for Mr. Pryde to receive this monthly superannuation payment. However, the Tribunal clarified that under his contract, Mr. Pryde had the option to choose between contributing to a home superannuation scheme (in New Zealand), the Fiji National Provident Fund, or selecting another superannuation fund of his choice. According to the Tribunal’s ruling, he chose to direct these payments to an offshore account.

The ruling noted that while his contract did not specify an amount for the superannuation entitlement, during his tenure as Solicitor General, Mr. Pryde’s contributions were made to the offshore fund in line with the mandated contributions of the FNPF, converted monthly to U.S. dollars.

Additionally, the Tribunal acknowledged a submission from the Fiji Law Society, affirming that Mr. Pryde’s right to receive superannuation was indeed stipulated in his employment contract, which was sanctioned by the President. This led the Tribunal to determine that the approval for the payment was established, supporting the conclusion that Mr. Pryde did not engage in any misconduct concerning the allegations made against him.

This decision underscores the importance of contractual obligations and proper governance procedures within public service roles. The Tribunal’s findings may serve to restore confidence in the administrative processes surrounding high-ranking officials, emphasizing that every payment was lawful and recognized in his employment terms.
