The Constitution Amendment Bill set to be presented in Parliament is primarily aimed at modifying the procedural aspects of the 2013 Constitution rather than altering its fundamental principles. Attorney-General Graham Leung articulated that this forthcoming Bill, scheduled for its first reading next Monday, serves as a technical document focused on procedural adjustments.
Leung stressed the importance of a constitution being dynamic and aligned with the people’s will, asserting that a constitution imposed without public input lacks legitimacy. He made a comparison to the complicated and often criticized amendment process of Fiji’s Constitution, highlighting the need for a more adaptable framework akin to that of the U.S. Constitution—which has seen 27 amendments since its inception in 1788. This comparison underlines the critical role of flexibility in ensuring a constitution remains relevant and conducive to democratic growth.
The 2013 Constitution, which emerged under the Bainimarama regime, has been the subject of criticism, particularly regarding its implementation process that was perceived as lacking robust public engagement. Leung pointed out that many concerns about change arise from a lack of understanding about its importance in a young democracy.
To address this, he noted that a more inclusive process would be initiated to allow diverse opinions on constitutional changes, thereby fostering a more participatory governance framework. Additionally, Leung mentioned the introduction of a new code of conduct law during the current parliamentary session, reinforcing the government’s dedication to reform and transparency.
This legislative initiative is viewed positively, as it reflects a proactive approach by the government to align with the aspirations of its citizens. The proposed changes could pave the way for a more unified and engaging democratic environment in Fiji, encouraging citizen involvement in the shaping of their governance.
