Commission chair Pravesh Sharma emphasized that Section 11(1) of the Fijian Constitution guarantees every individual’s right to be free from degrading treatment, a fundamental principle that must always be honored.
Sharma added that while Section 17(1) allows for freedom of publication, it is essential that this freedom is exercised responsibly. He stated, “The media has a duty to ensure their reporting is accurate and fair, avoiding sensationalism that could undermine the dignity of individuals or groups and contribute to discrimination.”
He pointed to recent reports alleging that a mother was denied access to her children by their father, a member of the Grace Road Church Group. Sharma explained that such sensitive matters should be handled via the appropriate legal channels, like the Family Court, allowing the mother to seek legal recourse regarding her children’s custody or contact.
Moreover, Sharma criticized public statements made by the Ministry of Employment, Productivity and Workplace Relations about alleged violations by the Grace Road Church Group. He called for adherence to natural justice principles, stressing that the Group should be allowed a fair chance to respond to accusations before any public claims are made.
The Commission often receives complaints about the exploitation and human rights violations against migrant workers by local employers. However, Sharma pointed out a troubling inconsistency: similar public condemnations for these employers do not seem to occur.
He reiterated the importance of treating the Grace Road Church Group with fairness and without discrimination, as outlined in Section 26 of the Constitution. The Commission urges all involved to approach this situation justly and with respect, emphasizing the necessity of equality in dealing with such matters.
