Fiji’s Corrections Commissioner, Dr. Jalesi Nakarawa, has been placed on leave, but he is challenging the government’s authority to do so, specifically disputing the powers held by Minister for Justice Siromi Turaga under the Corrections Act. Dr. Nakarawa expressed concern about not being informed of any allegations against him that would justify an investigation.

In a statement responding to the government’s announcement, Dr. Nakarawa noted that he had not received any prior indication of issues warranting scrutiny and emphasized the importance of natural justice, which typically involves being notified of allegations and given a chance to respond. He plans to draft a response to the Minister’s notification while also exploring other potential legal options.

The Commissioner highlighted that while a minister can appoint a committee to investigate matters affecting the corrections system, the Act does not grant the Minister the authority to place a Constitutional Officer on leave pending investigation.

This situation raises significant questions about transparency and accountability within Fiji’s correctional system. Dr. Nakarawa’s resolve to seek clarification and defend his position highlights a commitment to due process within government operations.

As this story unfolds, it serves as a reminder of the critical importance of upholding legal protocols and the rights of individuals in governance, promoting a fair and just system in Fiji.
