COI Hearing on FICAC Commissioner Appointment Faces Possible Extension

The Commission of Inquiry (COI) tasked with examining the controversial appointment of Fiji Independent Commission Against Corruption (FICAC) Commissioner Barbara Malimali is contemplating extending its sessions until late next month. The hearings, which commenced on Monday, are initially slated to hear from 35 witnesses over a two-week period.

Justice David Ashton-Lewis, the sole commissioner, mentioned the possibility of requesting the President, Ratu Naiqama Lalabalavu, for an extension until the end of February. “We will likely need another four weeks as we are currently behind in witness examinations,” he noted, emphasizing the importance of complete and thorough questioning in this significant matter.

The slow pace of the inquiry is attributed to the detailed nature of the witness questioning. Justice Ashton-Lewis underlined that responses must be substantive rather than simple affirmations or negations, facilitating a deeper understanding of the witnesses’ honesty through cross-examination. “So far, Ms. Mason and I feel that all witnesses are making a genuine effort,” he remarked.

As of now, five witnesses were scheduled for the initial day of hearings, with only Prime Minister Sitiveni Rabuka and Supervisor of Election Ana Mataiciwa having taken the stand. A total of 28 witnesses remain to provide their testimonies.

This inquiry reflects the commitment to ensuring transparency and accountability within Fiji’s institutions, showcasing the importance of a thorough examination of claims that affect the foundational structures of governance.
