The Shadow Minister for Justice, Ketan Lal, has called on Prime Minister Sitiveni Rabuka to take accountability for the Coalition Government’s alleged infringements of the 2013 Constitution. Lal expressed serious concern regarding the recent decision by Minister of Justice, Siromi Turaga, to place Commissioner of Corrections Dr. Nakarawa on leave, which he argues raises procedural issues and reflects an overreach of ministerial authority.
Lal emphasized that the Commissioner of Corrections holds an independent constitutional position and is appointed by the President, making them immune to the directives of a line minister regarding employment matters. He references Section 137(4) of the Constitution, which delineates that only the President, on the advice of the Constitutional Offices Commission, can suspend the Commissioner and other officers appointed by this commission.
Concerns were also raised regarding the lack of transparency surrounding the allegations against Dr. Nakarawa, as he has reportedly not been informed of any charges and has contested the validity of his forced leave. Lal noted that this abrupt decision further damages public trust in governmental institutions and reflects a troubling trend where the Coalition Government appears to be targeting public officials for performing their duties independently.
Lal urged Prime Minister Rabuka not to dismiss these issues lightly or shift blame to another minister. He asserted that the people of Fiji deserve clarity and accountability from their leaders, especially concerning the integrity of constitutional offices.
