The Public Service Disciplinary Tribunal has mandated the Ministry of Finance to reinstate Ashwin Nand, a suspended civil servant, following his involvement in multiple misconduct incidents. Nand faced accusations that ranged from transporting alcohol in a government vehicle to forcibly entering the vehicle of the Assistant Minister of Finance.
The events leading to the tribunal’s ruling took place between December 2023 and February 2024. The tribunal, composed of four members, determined that while Nand should be reinstated, the Ministry of Finance must issue a written reprimand denouncing his misconduct, which included consuming alcohol during work trips, damaging a colleague’s phone, failing to attend scheduled meetings, and not treating coworkers with the necessary respect.
In addition, the tribunal instructed the ministry to formally notify Nand that any future breaches of conduct could lead to his termination. However, they decided that his withheld salary from May 29, 2024, would not be reinstated.
Nand is required to return to work within seven days from Friday, December 20, the day of the tribunal’s decision.
This situation highlights the importance of accountability in public service while also emphasizing the possibility of rehabilitation and second chances. By allowing Nand to resume his position with a clear warning, the tribunal has reaffirmed the need for standards of conduct while providing an opportunity for improvement and learning from past mistakes.
