The Magistrate’s Court in Labasa issued a ruling on Friday directing the Land Transport Authority (LTA) to refund a businessman $20,000 after he was improperly fined through Traffic Infringement Notices (TINs). Sanjeev Reddy, a 50-year-old entrepreneur from Vunika, faced significant financial distress due to TINs that ultimately led him to close his trucking business.
Mr. Reddy, whose representation carried by attorney John Prasad, attended the court on three occasions. The original charges stemmed from a fine of $2,000 issued in July 2019 for allowing someone else to drive his vehicle while it was overloaded. He later received two additional fines amounting to $13,000 and $5,000, which contributed to the decision to pivot from trucking to running a shop for income.
During the court proceedings, Magistrate Safaira Ratu evaluated the evidence presented by both Mr. Reddy and the prosecution. Her conclusion was clear: the prosecution did not meet the burden of proof necessary for a conviction, leading her to question the qualifications of the prosecution witness. As a result, the court dismissed the TINs against Mr. Reddy, acquitted him, and mandated that the LTA reimburse the fines paid by him within 21 days.
