Prominent businessman and former Telecom Fiji Limited Director Sanjay Kaba has pleaded not guilty to charges of Obtaining Financial Advantage by Deception at the Suva Magistrates Court. Represented by Wasu Pillay, Kaba appeared before Resident Magistrate Krishnan Prasad, who allowed him to travel abroad between March 1 and 18, with a condition to surrender to the court on March 19. A stop departure order previously imposed on Kaba has been temporarily lifted, permitting him to retrieve his passport from the Court Registry, though he must return to court after his travel.
The allegations against Kaba stem from his time on the boards of Telecom Fiji Limited and Amalgamated Telecom Holdings Limited from January 27, 2017, to January 20, 2019. He is accused of engaging in misconduct by submitting a bid through his company, Houng Lee Kaba Jacob Limited, for project management services related to TFL’s new office and data center project. The Fiji Independent Commission Against Corruption (FICAC) claims that Kaba obtained a financial advantage of over $766,327 between June 2022 and July 2023, knowing his company was ineligible due to his failure to declare his interest as a directorship.
This case has garnered attention for highlighting ongoing efforts to combat corruption and promote accountability in Fiji’s corporate governance. With a significant amount of money involved, the ramifications of the case extend beyond Kaba himself, reflecting on the broader ethical standards expected of individuals in positions of power. The resolution of this trial holds the potential for reinforcing public trust in governance practices and could provide a notable precedent regarding transparency and integrity in both governmental and corporate spheres.
As these legal proceedings progress, there is hope that this case will strengthen ethical standards and lead to a culture of accountability, fostering greater awareness against financial misconduct in the future. The upcoming court date on March 19 is expected to be a pivotal moment in determining the course of this significant legal battle.
