Burglary Case Delay: What’s Next for the Accused?

The sentencing hearing for one of two men charged with aggravated burglary has not yet begun, as the State is not prepared to proceed. State attorney Hezekiah Nofaga stated that he still needs to determine the remand period for the accused, Saula Luveitasau, who has pleaded not guilty to the charge.

Luveitasau and his co-defendant, Taito Soko Tuilevuka, are facing two counts of aggravated robbery and two counts of theft. Their case was heard last Thursday by Justice Pita Bulamainaivalu at the High Court in Suva. The State alleges that the two men unlawfully entered the Zheng Shopping Centre, resulting in the theft of items and cash totaling over $3,000.

During the hearing, Luveitasau revealed that he has been in custody for two years and one month. Justice Bulamainaivalu granted the prosecution 14 days to conduct the necessary calculations.

Meanwhile, Tuilevuka, who also pleaded not guilty, is scheduled to go on trial for two weeks starting March 17 of next year. His case will be reviewed later this month to assess the preparation for the trial.

Both defendants are permitted to submit filings and additional materials before October 17 in relation to Luveitasau’s sentencing hearing.
