Bainimarama and Qiliho Set to Challenge Convictions in Major Appeal

Former Prime Minister Voreqe Bainimarama and former Police Commissioner Sitiveni Qiliho have received the court’s approval to appeal their convictions in a full court hearing. The decision was conveyed to both the State Prosecution and the defense lawyers during a session held yesterday morning.

The appeal seeks to challenge their convictions based on several legal grounds, including the alleged misapplication of the Brown v. Dunn rule and issues surrounding the interpretation of specific sections of the Sentencing and Penalties Act. Additionally, Bainimarama and Qiliho have raised concerns regarding Chief Justice Salesi Temo’s refusal to recuse himself from their case.

The court indicated its willingness to entertain these questions in the hope of addressing why there was a lack of response when the original application was tendered to the High Court. Lawyers Devanesh Sharma and Fatima Gul, representing the defendants, have requested that the case be scheduled for a full court hearing during the session in July.
