The Fiji Court of Appeal is set to continue hearings regarding bail for former Police Commissioner Sitiveni Qiliho, who is currently serving a one-year sentence. Qiliho appeared before Justice Chandana Prematilaka at the Veiuto Court Complex alongside former Prime Minister Frank Bainimarama, who was granted early release last month.
Both men were convicted by the High Court in Suva on March 14 of this year. During the proceedings, their attorney, Devanesh Sharma, informed the court that they were withdrawing the prior motion concerning their conviction and sentencing, which had been submitted on April 23 of last year. This motion pertained to a request for a stay on their sentences in the Court of Appeal; however, the case proceeded without it. Sharma expressed optimism that Qiliho would be granted a similar early release to that of Bainimarama.
Justice Prematilaka has provided the applicants 21 days to file their submissions for bail pending appeal, after which the State has until January 21 to respond. Sharma will then have until January 28 to reply to the State’s remarks, with the next mention date scheduled for January 30.
In summary, the case is progressing through the legal system, with opportunities for both sides to present their arguments. This situation highlights the ongoing legal processes and the possibility of changes in the decisions regarding Qiliho’s sentence.
It remains hopeful that with a thorough examination of the appeals and appropriate legal representation, justice will be served fairly for all parties involved. This case also underscores the importance of the judicial system in addressing matters of conviction and sentencing, ensuring that defendants have the opportunity to pursue their legal rights.
