Former Fiji Independent Commission Against Corruption Deputy Commissioner Francis Puleiwai has formally requested an investigation into her successor, Barbara Malimali, regarding alleged misconduct and the improper issuance of a Stop Departure Order. In her letter to the Chief Registrar, Puleiwai claims that Malimali’s actions on September 7 seemed purposeful, as there was no ongoing investigation at that time, and the Stop Departure Order was not executed within the mandated 24-hour timeframe.

Puleiwai asserts that Malimali’s conduct deviated from legal protocols, stating, “It is clear that the Stop Departure Order was employed to prevent me from leaving the country while she compiled a case against me, which is a blatant misuse of her authority.” Furthermore, Puleiwai believes that Malimali’s police complaint against her is likely to be unsuccessful, as her actions on September 5 were taken in good faith and in accordance with the FICAC Act 2007, which grants her immunity from any criminal or civil action regarding those actions.

Additionally, Puleiwai highlighted that the Stop Departure Order remains active in the Immigration System without being rescinded, despite the procedural errors involved. She criticized Malimali for failing to communicate with the Director of Immigration to correct this erroneous order.
