Lawyer Seforan Fatiaki has raised serious allegations regarding the arrest and detention of citizen journalist Charlie Charters by the Fiji Independent Commission Against Corruption (FICAC). According to Fatiaki, the motives behind Charters’ detention appear to revolve around extracting sensitive information rather than conducting a genuine criminal investigation.

In a formal statement submitted to FICAC, Fatiaki revealed that Charters has been informed he is being investigated for allegedly assisting a FICAC officer in unlawfully disclosing official information. However, Fatiaki pointed out that FICAC has failed to identify the officer in question and seems uncertain about the officer’s identity altogether.

Fatiaki described instances where senior FICAC investigator Mosese Matanisiga allegedly informed Charters that he could expect to be released without further investigations if he were to disclose the source of his information. Witnesses to these claims included Charters’ wife and two legal representatives, raising questions about the transparency of FICAC’s operations.

Fatiaki asserted that the agency’s actions indicate that their primary interest lies in obtaining information rather than treating Charters as a suspect in a legitimate investigation. He contended that if Charters does not willingly provide this information, FICAC should not have the legal authority to use coercive detention tactics to obtain it.

Furthermore, Fatiaki condemned the FICAC’s actions as a significant abuse of power, particularly criticizing the agency’s restriction on Charters’ ability to leave Fiji, which undermines principles of due process and the rule of law. This situation has sparked a dialogue around the limits of authority exercised by governmental bodies and the protection of individual rights within the legal framework in Fiji.

As the case unfolds, it highlights the ongoing discussions about transparency and accountability within law enforcement agencies. Advocates are hopeful that this incident will encourage a reevaluation of practices at FICAC and reinforce protections for journalists and citizens engaging in information dissemination.
