A corrections officer has been acquitted of charges related to the alleged theft of an Apple mobile phone from a businessman in Vatuwaqa. The case involved Sefanaia Lesumaitagai, who faced accusations of aggravated robbery concerning a mobile phone worth $3,899 and a wallet containing $500, which brought the total value of stolen items to approximately $4,933.

During a court session on Wednesday, Magistrate Yogesh Prasad highlighted that the prosecution’s attempt to move forward with the case faltered when police were unable to provide adequate evidence. The prosecution sought an adjournment, acknowledging discrepancies in the charges filed against Lesumaitagai. His defense team, led by lawyers Jiten Reddy and Yogen Kumar, objected to the delay, pointing out that the police lacked jurisdiction to withdraw charges without the Office of the Director of Public Prosecutions’ authority.

Ultimately, the magistrate insisted that the prosecution should proceed with calling witnesses. However, when they could not present any evidence to support their claims, Reddy applied for an acquittal under section 178 of the Criminal Procedure Act, which was granted.

This case’s outcome underscores the importance of solid evidence in the judicial process and the rights of the accused to a fair trial.
