The Electoral (Local Government Elections) Regulations 2025 introduce stringent measures aimed at preserving the integrity of the voting process. Key offenses defined in this regulation include bribery, undue influence, impersonation, and ballot interference, all of which are critical in ensuring fair electoral practices.

Bribery is classified as a Category A offense under these new regulations. The law criminalizes actions from both parties involved in such transactions. This means that individuals who either solicit or accept benefits with the understanding that it may affect their voting or political support, and those who provide such benefits, can face serious legal consequences. However, there is an important exception: legitimate public policy announcements or promises regarding public actions do not fall under this prohibition.

Undue influence is also categorized as a Category A offense. This provision captures any actions that undermine another person’s right to participate freely in elections. It includes acts of intimidation or coercion, emphasizing protection even in situations where financial inducement is absent.

Election impersonation is considered equally serious. This offense encompasses attempts to vote on behalf of another individual, whether that person is alive or deceased, and includes knowingly impersonating election officials.

The regulations take a particularly hard stance on ballot-related offenses. Apart from cases explicitly permitted by law, it is illegal for anyone other than the voter to mark a ballot paper. The dissemination of materials intended to mislead or encourage improper voting practices is similarly prohibited, whether through written instructions, gestures, or verbal suggestions.

Tampering with ballot boxes stands as another serious violation. Actions such as inserting unauthorized papers, removing ballots from polling stations, or interfering with the handling of ballot packets are all considered Category A offenses, although voters can present evidence of genuine error for lesser penalties under a Category B classification.

By establishing these clear and robust guidelines, the 2025 regulations represent a significant step towards safeguarding the electoral process and fostering trust in democratic institutions. The commitment to uphold fair voting practices bodes well for future local government elections, encouraging voter participation and confidence.
