The Suva Magistrate’s Court has issued a bench warrant for Isikeli Komaisavai, the former vice-president of the Social Democratic Liberal Party (SODELPA) in the Nasinu constituency, due to his failure to appear for a scheduled hearing. Komaisavai, who is 52 years old, is facing a charge of causing harm through electronic communication.
The allegations against him stem from a Facebook post made on February 10, 2021, in which he reportedly called for violence against the then Attorney-General, Aiyaz Sayed-Khaiyum. During the court proceedings, police prosecutor Sharmila Lata informed Magistrate Jeremaia Savou that all witnesses were present, except for Komaisavai. Consequently, she requested that the trial proceed without him, a motion the court accepted.
Among the witnesses called to testify was Attorney-General Sayed-Khaiyum himself. The case has now been scheduled for adjudication on December 17.
This situation underscores the importance of accountability and the legal ramifications of online statements, particularly those that threaten violence. It also serves as a reminder of the court’s commitment to ensure that all parties involved in a case are heard, irrespective of the absence of the accused.
As the case moves forward, it highlights an opportunity for discussions around the responsible use of social media and the impact that words can have, potentially prompting constructive dialogue within the community.
