The Suva Magistrate’s Court has issued a bench warrant for Isikeli Komaisavai, the former vice-president of the Nasinu constituency for the Social Democratic Liberal Party (SODELPA), after he failed to appear for his scheduled hearing. Komaisavai, who is 52 years old, is facing a charge related to causing harm through electronic communication.

The allegations date back to February 10, 2021, when it is claimed that he posted a comment on Facebook that called for violence against the then Attorney-General Aiyaz Sayed-Khaiyum, including a statement suggesting that he would be killed.

During the court proceedings, police prosecutor Sharmila Lata informed Magistrate Jeremaia Savou that all witnesses were present, but Komaisavai was not. Following this, she requested that the trial proceed without the accused, which the court accepted. Notably, one of the prosecution witnesses is Mr. Sayed-Khaiyum himself, who has been called to testify against Komaisavai.

The case is now set to resume on December 17, when a judgment will be delivered.

This case highlights the serious implications of online communication and the responsibilities that come with it. As society increasingly engages in digital discourse, it serves as a reminder of the legal consequences that can arise from threats and harmful statements made in the public sphere. The judicial system’s willingness to proceed with the trial despite the absence of the accused reflects its commitment to addressing such issues responsibly.

In a hopeful light, this situation could promote a more thoughtful and respectful dialogue across social media platforms, encouraging individuals to consider the impact of their words and actions. It may also foster a stronger community commitment to upholding law and order in the digital age.
