The Suva Magistrate’s Court has issued a bench warrant for Isikeli Komaisavai, the former vice-president of the Nasinu constituency of the Social Democratic Liberal Party (SODELPA), following his absence at a scheduled hearing. Komaisavai, 52, is facing charges related to causing harm through electronic communication.
The charge stems from an incident on February 10, 2021, when he allegedly made a threatening comment on Facebook regarding then Attorney-General Aiyaz Sayed-Khaiyum, suggesting he should be killed. During the court session, police prosecutor Sharmila Lata informed Magistrate Jeremaia Savou that while all prosecution witnesses were present, Komaisavai was not. She requested the trial to proceed in his absence, which the court approved.
Notably, among those witness for the prosecution is Mr. Sayed-Khaiyum himself, who has been summoned to testify against Komaisavai. The case has been adjourned, and a judgment is expected to be delivered on December 17.
This development underscores the importance of accountability in public discourse, particularly when it comes to sensitive matters involving public officials. The court’s actions reinforce the responsibility individuals have when expressing opinions, especially in digital formats.
As the legal process unfolds, it serves as a reminder that respectful dialogue is foundational in maintaining civil society. The situation also points toward a larger conversation about the implications of social media use in expressing dissent or frustration, emphasizing a need for dialogue over threats.
