“Urgent Call for Review: Outdated Act Puts Fiji Burial Sites at Risk”

The Fiji Corrections Service (FCS) has issued an urgent call for a review of the Burial and Cremation Act 1911. This Act, overseen by the Ministry of Health, remains outdated and does not address the current responsibilities and challenges faced by the FCS in managing urban burial sites.

Over time, the FCS has assumed the role of managing these sites to ensure that burials are conducted with respect and that the burial grounds are well-maintained. However, FCS Commissioner Jale Nakarawa pointed out that this role is not officially recognized within the existing legal framework, leading to significant operational challenges.

“While we are dedicated to the upkeep of burial sites, the FCS lacks the necessary resources to adequately police these areas and prevent vandalism,” Mr. Nakarawa stated. “The legal framework does not equip us with the authority or means to effectively address damage and security concerns.”

The FCS has noted an increase in vandalism and damage to burial sites, which it is currently unable to fully address or prevent, and it is not liable for any damage or desecration caused by such acts.

A review of the Burial and Cremation Act 1911 may also require reconsideration and regulation of certain practices to ensure sustainable management of burial sites. The cultural tradition of decorating graves, while significant, contributes to an accumulation of rubbish that must be cleared regularly, placing further strain on FCS resources.

The long-overdue review of this Act is essential to clearly define the FCS’s responsibilities and provide the necessary resources and authority for effective management of burial sites.

“We urge the Government and relevant stakeholders to prioritize the review of the Burial and Cremation Act 1911,” Mr. Nakarawa emphasized. “This is crucial for the FCS to continue its role in managing urban burial sites and to protect these sacred spaces from neglect and vandalism.”
