Trial Set for Controversial Political Removal: Niko Nawaikula’s Fight for Justice

A trial date has been established for the case involving former Social Democratic Liberal Party (SODELPA) member Niko Nawaikula. Nawaikula has initiated legal action against Mohammed Saneem, the former Supervisor of Elections, along with the Office of the Attorney-General, for allegedly providing unlawful and negligent advice that led to his dismissal from Parliament by former Speaker Ratu Epeli Nailatikau.

This case stems from an incident in August 2021, when he was expelled from Parliament for using a name not reflected on his birth certificate. His official birth certificate lists him as Nikolau Tuiqamea, while he was known in Parliament as Niko Nawaikula.

The previous Chief Justice, Kamal Kumar, reviewed the matter and concluded that no issues were present. Following the dismissal of that case, Nawaikula decided to file a lawsuit against the aforementioned parties for their purportedly negligent and unlawful guidance regarding his expulsion.

On Tuesday, Nawaikula appeared before Justice Usaia Ratuvili at the High Court in Suva, represented by his new attorney, Sevuloni Valenitabua. During the hearing, Valenitabua informed the court that they had received the requested copy of the plea from the defense and were prepared to schedule a hearing date. He also mentioned that only one witness would be called for the case.

After both sides indicated there were no further issues, the court adjourned the case, setting the trial for April 28-30, 2025.
