A man previously warned for cursing a judge is requesting bail due to issues he encounters at the remand center. Tomasi Bose appeared in court this week before Justice Dane Tuiqereqere, facing charges of robbery and seriously assaulting a taxi driver.
Bose expressed to the court his desire for bail, citing poor conditions in his cell and restroom facilities at the remand center, as well as a need to fulfill family obligations. However, the Director of Public Prosecutions (DPP), Zenith Zunaid, objected to the bail request.
Zunaid highlighted that Bose has ongoing charges in the Magistrate’s Court related to theft and property damage, as well as a case in the High Court in Suva concerning aggravated robbery. He noted that both incidents were connected in nature.
The prosecution indicated that Bose had declined to participate in an identification parade, which they argued could be detrimental to the complainant. Zunaid mentioned that the complainant is confident in identifying the person who assaulted him and stole his belongings.
Evidence against Bose includes CCTV footage that, while not clearly showing his face, does display distinctive clothing and tattoos. Zunaid argued that releasing Bose would pose a potential risk to public safety.
Justice Tuiqereqere instructed Zunaid to investigate other pending cases involving Bose and to determine whether he had ever failed to appear in court. The State is required to submit a supplementary response by tomorrow, with a ruling expected on October 1.
