Since its establishment, the Legal Practitioners Unit has addressed a staggering 3,915 complaints against lawyers, according to Attorney-General Graham Leung. Speaking at the 2024 Fiji Law Society annual convention in Nadi, he expressed concern over the troubling reality that inexperienced lawyers are permitted to practice, potentially misleading clients who believe that all law degree holders possess equivalent capabilities.
Leung candidly remarked that the competency of some lawyers is lacking, highlighting issues such as inadequate communication skills, limited understanding of legal ethics, and a fundamental grasp of the law. He noted that many have deviated from the essential principles of law and ethical conduct in legal practice.
In line with these concerns, Acting Chief Justice Salesi Temo recently lamented the absence of standards among some younger lawyers during an admission ceremony. The complaints reported to the Legal Practitioners Unit encompass a range of issues, including breaches of trust accounts, practicing without a valid certificate, conflicts of interest, failure to refund fees for unfulfilled work, overcharging, and criminal charges against practitioners.
From the total complaints, 1,910 have been successfully resolved, while 2,005 remain pending, indicating ongoing challenges within the legal profession.
This situation underscores the necessity for institutions to enhance training and standards among aspiring lawyers. Legal bodies might consider implementing more rigorous oversight and educational measures to ensure that future lawyers meet the high expectations expected in their roles. Promoting a culture of integrity and professionalism in the legal field can serve as a foundation for restoring public trust in legal practitioners and ultimately strengthening the justice system as a whole.
Summary: The Attorney-General reported 3,915 lawyer complaints, highlighting competency issues among new practitioners and the need for improved standards and training in the legal profession. 1,910 complaints were resolved, with 2,005 still pending.
