Stricter Laws Ahead for Nightclubs: Are Changes Coming?

Under the current legal framework, businesses are not mandated to ensure the safety of their customers or to prevent violent incidents on their properties. However, Attorney-General Graham Leung has pointed out that there are existing provisions in legislation that address this issue.

According to Mr. Leung, section 72 of the law places an obligation on nightclub owners to prevent drunkenness and disorderly conduct. The recent Liquor (Amendment) Act 2023, while altering the hours during which alcohol can be sold, still maintains these critical safety regulations.

Under the Liquor Act, bar and nightclub owners are prohibited from serving alcohol to patrons who have already consumed a reasonable quantity or who appear intoxicated. Licensees who violate this law face fines up to $500. Additionally, it is unlawful to buy alcohol on behalf of someone who is drunk, indicating a broader intent to curb alcohol abuse in nightlife settings.

The Attorney-General emphasized the importance of better enforcement of these existing laws and suggested that the current fines may be insufficient to deter licensees from allowing disorderly behavior on their premises. He proposed that the government may need to consider increasing these penalties as a means of reinforcing stricter compliance.

Moreover, Mr. Leung indicated that a thorough review of the security industry is necessary to establish basic standards and regulations for personnel working in this field. He is set to meet with members of the Central Liquor Board to discuss potential enhancements to the current liquor laws based on their insights and recommendations.
