Revamping Workplace Laws: What’s Next for Fiji?

The Employment Relations Act 2007 is undergoing a significant review, as announced by Minister for Employment, Productivity and Workplace Relations, Agni Deo Singh. This review arises from the need to ensure that the legislation remains relevant after two decades of changes and adapt to contemporary requirements. Singh emphasized that laws must be periodically updated and highlighted that unilateral modifications made by the previous administration have created discrepancies that need to be rectified to comply with International Labour Organisation (ILO) conventions.

Singh stated, “Any law needs to be reviewed from time to time, to make it relevant for the current needs.” The review process coincides with public consultations being held across various regions, starting in Sigatoka and expanding to areas including Ba, Tavua, Rakiraki, Nausori, Navua, and Suva.

Earlier consultations in Nadi generated considerable interest, particularly regarding proposed amendments that could significantly increase penalties for harassment offenses, including sexual harassment. The discussion revealed proposed fines reaching up to $50,000 for individuals and as high as $200,000 for companies found guilty of such offenses. The aim is to enhance workplace protections and ensure accountability, aligning Fiji’s employment laws more closely with international standards.

Stakeholders, including representatives from the Fiji Commerce and Employers Federation, have raised concerns regarding the potential adverse effects of these proposed changes, particularly on micro, small, and medium enterprises (MSMEs) that constitute a significant portion of Fiji’s workforce. These organizations stress the importance of balancing worker protection with business sustainability.

Looking forward, the ongoing consultations present a promising opportunity for cohesive dialogue among all involved parties, striving for a legal framework that upholds the rights of workers while also considering the realities faced by employers. This collaborative engagement may lead to reforms that foster a safer, more equitable workplace environment in Fiji, promoting both economic stability and improved worker rights.
