The Ministry of Employment, Productivity, and Workplace Relations is currently engaged in nationwide public consultations regarding the proposed Employment Relations Bill and the Work Care Bill. This review is part of an ongoing effort to adapt labor laws to the evolving workforce landscape, ensuring protection against exploitation and setting minimum employment terms while enhancing job security.

Minister for Employment, Agni Deo Singh, remarked that this review process originated in 2012 and has aimed to align with international labor standards. The proposed legislation seeks to facilitate economic growth through improved productivity, address better workplace enforcement, and respond to climate-related employment challenges.

Consultations are designed to collect input from various stakeholders, including employers, employees, and the public, with the objective of refining the proposed bills. Minister Singh also mentioned that a subcommittee, formed in 2023 under the Employment Relations Advisory Board, would play a pivotal role in this review.

The recent feedback sessions, which have spanned different regions, have witnessed active participation, although concerns have been raised regarding the limited timeframe allowed for input. The Fiji Commerce and Employers Federation (FCEF) has emphasized the need for more time and access to draft legislation to facilitate meaningful participation in the consultation process.

In light of the FCEF’s concerns over the adequacy of the consultation timeframe and forthcoming issues related to the proposed bills, Singh has assured that the consultation phase is ongoing, with plans for a second round of public consultations scheduled after the Cabinet review of feedback.

The work ahead, particularly with the Work Care Bill, aims to streamline processes for workplace accident compensation, which has been an area of concern for businesses dealing with unresolved claims. Stakeholders express optimism that the proposed reforms will lead to a more efficient system while maintaining protections for workers.

Overall, the public consultations symbolize a critical step toward reforming Fiji’s labor law landscape, aiming for a balanced legislative framework that considers the needs of both the workforce and employers.
