Revamping Nightclub Safety: Will New Legal Amendments Tackle Violence?

Current legislation does not hold businesses sufficiently accountable for ensuring the safety of their patrons and preventing violent incidents on their premises. Attorney-General Graham Leung has pointed out that while Section 72 of the law requires nightclub owners to control drunkenness and disruptive behavior, there are still challenges in enforcing these provisions effectively.

According to Mr. Leung, the Liquor (Amendment) Act 2023 has revised the hours during which liquor can be sold, but the current legal framework provides mechanisms to mitigate potential acts of violence. Notably, nightclub owners are prohibited from selling alcohol to patrons who are already intoxicated or who have purchased more liquor than they can consume. Violations of these regulations can result in fines of up to $500.

Mr. Leung emphasized the importance of enforcing existing laws more rigorously, suggesting that increasing the fines could serve as a more potent deterrent against licensees who permit excessive drunkenness on their premises. He also indicated that a review of the security industry may be necessary to establish standards and rules for those working in that field.

A forthcoming meeting between the Attorney-General and the Central Liquor Board aims to explore potential improvements to liquor laws, as the board may provide valuable insights based on their experience and observations in the sector.
