Rethinking Nightclub Safety: Is the Law Enough?

Current legislation holds businesses less accountable for ensuring the safety of their customers and preventing violent incidents in or around their establishments. However, Attorney-General Graham Leung points out that section 72 of the current law mandates nightclub licensees to prevent drunkenness and unruly behavior on their properties.

With the recent Liquor (Amendment) Act 2023, which adjusted the hours for the sale of alcohol, the Attorney-General noted that existing provisions still offer mechanisms to avert potential violence. Legally, nightlife venues are not allowed to serve customers who have already consumed a reasonable amount of alcohol, and failing to comply can lead to a hefty fine of up to $500. There are also strict regulations against supplying alcohol to intoxicated individuals or allowing someone to purchase on behalf of a drunk person.

Mr. Leung indicated that the fines may be insufficient and suggested the cabinet might need to consider increasing penalties as a deterrent for establishments that overlook drunken behavior. He also emphasized the necessity for a thorough review of the security industry as a whole, advocating for a set of basic rules or standards for security personnel.

The Attorney-General plans to convene with members of the Central Liquor Board shortly, which plays a crucial role in advising government policy on liquor laws. Their insights may help identify ways to enhance current legal frameworks effectively.

This call for stronger enforcement and potential updates to regulations signals a proactive approach to curb violence and improve safety in nightlife settings, fostering a more secure environment for patrons. The government’s willingness to engage with industry experts illustrates a commitment to continually adapt and respond to evolving societal needs, ultimately aiming to create a safer community for all.
