Remandee’s Controversial Communication: A Case of Concern

A 25-year-old man, accused of murdering his pregnant wife in an apartment in Suva, has reportedly been using a mobile phone while in remand to communicate with his daughter. This information was presented by DPP prosecutor Monisha Naidu, who opposed Apisai Madigibuli’s bail application during a hearing at the High Court in Suva, overseen by Justice Dane Tuiqereqere.

Mr. Madigibuli is alleged to have fatally stabbed Kitiana Baravilala with a kitchen knife on April 25. Ms. Naidu raised concerns in court regarding an email from the sister of the deceased, identified as a State witness, which indicated that the accused had been using an illicit phone to contact his friend in an effort to reach out to his daughter. The child is currently living in Savusavu with her aunt, who is reportedly frightened by the situation.

Ms. Naidu stated that Mr. Madigibuli poses a significant risk to State witnesses, as his actions suggest a potential for interference. Justice Tuiqereqere acknowledged that as a father, the accused may attempt to communicate with his children, but noted that the use of contraband devices was prohibited by the Fiji Corrections Service and police. He clarified that while the communication itself does not constitute witness interference, the prosecution should submit the email as part of their affidavit concerning the bail matter.

Defense attorney Paula Gade is required to file submissions regarding the prosecution’s bail response by October 11. Mr. Madigibuli remains in custody, with his bail hearing scheduled to begin on October 15.
