PM’s Next Move: A Call for Truth and Transparency

Former Attorney General Aiyaz Sayed-Khaiyum has called on Prime Minister Sitiveni Rabuka to promptly establish a Commission of Inquiry under the Commission of Inquiry Act. He argued that this action would help restore public trust and demonstrate a genuine commitment to the rule of law, constitutionalism, and the independence of constitutional offices.

This statement follows allegations from former acting deputy commissioner of the Fiji Independent Commission Against Corruption (FICAC), Francis Puleiwai, who claimed that high-ranking government officials were interfering with FICAC operations. Sayed-Khaiyum emphasized that it is now up to Rabuka to prove his dedication to maintaining the rule of law and the independence of institutions as outlined in the Fijian Constitution.

He highlighted the urgency of such a move, noting its significance for investment confidence and economic stability, as Fiji’s economy is not growing as needed and income disparity continues to increase. He stressed that the Prime Minister’s action is crucial for enhancing Fiji’s reputation among regional and international partners.

Sayed-Khaiyum countered claims that a Commission of Inquiry would lack constitutional basis, asserting that it could focus on specific allegations without disrupting existing independent processes. He insisted that the commission must be composed of impartial members without any biases or connections to the implicated individuals, and that its terms must not be influenced by such individuals as well.

He warned that failing to meet these criteria could render the inquiry ineffective and aggravate the current issues.

In response, Prime Minister Rabuka acknowledged the importance of a Commission of Inquiry as a fair means to investigate allegations aimed at FICAC. He noted that an independent inquiry would adequately address concerns related to suspected ministerial interference. If it confirms these allegations, he stated that appropriate actions must follow as per the Commission’s recommendations.
