New Deputy DPP Appointment Sparks Legal Debate

The Attorney-General, Graham Leung, has confirmed the appointment of John Rabuku as the new deputy Director of Public Prosecution (DPP). This announcement follows Rabuku’s previous role as acting DPP, which he held until five weeks ago.

The acting DPP, Nancy Tikoisuva, officially announced Rabuku’s new role on Wednesday. This development comes after Leung had urged Rabuku to resign from his acting position due to the Supreme Court declaring him ‘ineligible.’

Leung emphasized that, according to the Constitution, the DPP has the authority to appoint staff independently. He noted that decisions regarding appointments belong solely to the DPP or the individual acting in that role, not to the Judicial Services Commission or the Attorney-General.

He also pointed out that if the acting DPP were to take leave, it is not guaranteed that her deputy would automatically take over her duties.
