New Deputy DPP Appointment Sparks Legal Clarifications

The Attorney-General, Graham Leung, has officially recognized the appointment of John Rabuku as the new deputy Director of Public Prosecution (DPP). This announcement came five weeks after Rabuku stepped down from his role as acting DPP. Acting DPP Nancy Tikoisuva revealed Rabuku’s new position on Wednesday.

Previously, Leung had urged Rabuku to relinquish his acting DPP role after the Supreme Court deemed his appointment ‘ineligible.’ He emphasized that the Constitution grants the DPP the authority to appoint their staff, indicating that such decisions are made solely by the DPP or the acting DPP, without needing consultation or approval from the Judicial Services Commission or the Attorney-General.

Leung also pointed out that, should the acting DPP take leave, it does not necessarily mean that the deputy would take over the responsibilities automatically.
