Niko Nawaikula, an experienced lawyer and former parliamentarian, has urged Barbara Malimali to step down amid an ongoing investigation that concerns her role. In a statement released on Friday, Nawaikula emphasized that it is both professional and ethical for individuals in positions of power to recuse themselves when facing allegations or inquiries that may impact their integrity.
Nawaikula referenced the Prime Minister’s decision to appoint a Commission of Inquiry led by eminent judge Ashton Lewis to examine the legality of Malimali’s appointment at the Fiji Independent Commission Against Corruption. He noted that the Prime Minister was depending on Malimali to act ethically and step aside while the investigation proceeds.
He drew parallels with Pio Tikoduadua, who took similar action in the past, underscoring that stepping aside is not just a norm but a responsibility grounded in integrity, impartiality, and the need to maintain trust within institutions.
According to Nawaikula, remaining in a position of authority while under investigation can create a perception of a conflict of interest, potentially undermining the fairness of the inquiry. He highlighted several key reasons for recusal: it allows for an unbiased investigation, preserves the institution’s credibility, demonstrates accountability, and helps avoid operational distractions during the inquiry process.
Nawaikula concluded that stepping aside reflects a commitment to ethical leadership over personal interests, essential in politics and corporate governance where public confidence is vital. He criticized the lack of support Malimali is receiving from her peers regarding this ethical obligation.
This situation illustrates the ongoing challenges faced in maintaining integrity within leadership roles and the importance of establishing public trust. It serves as a reminder that accountability and ethical conduct are foundational to effective governance and institutional resilience.
Given the context, it is hopeful that this situation may encourage discussions about ethical standards in public service and inspire other leaders to prioritize integrity in their actions.
